Information about the service, app usage and policies of Taxi Sonrisas Premium S.A.C.

In case of any discrepancy or dispute, the Spanish version shall prevail. References to Peruvian law (Law N° 29571, Supreme Decree N° 011-2011-PCM) apply regardless of language.

Terms and Conditions for the Passenger User

Initial considerations

The Taxi service is designed for the transport of PASSENGERS, driven by a professional driver who has passed verification of personal documents, review of criminal, judicial, police and bench-warrant records, and has been evaluated through extensive projective psychological and psychometric examinations. Likewise, our drivers receive monthly training and ongoing guidance in their daily work. Taxi Sonrisas has a technology platform that allows requesting services through a mobile app, a web app called Business System, and our phone dispatch center.

It is Taxi Sonrisas' vision that your experience be of the highest level and professionalism.

Service Conditions

Taxi Sonrisas is entitled to refuse service to people in evident state of intoxication, people with altered consciousness due to drug use, violent persons, persons who physically or verbally assault company staff, and/or any other situation that puts any person at risk, and may suspend or cancel the service in these circumstances.

Packages or Bulk Items

The passenger user may travel with regular small-sized packages, which may travel on the seat as long as they do not damage the upholstery, but should preferably be placed in the vehicle's trunk. If the service involves packages or bulk items larger than 12 kilos by volume or weight, the user must consult with the driver beforehand to agree on the applicable fare, as this is a special service. Likewise, it is the driver's prerogative to assess whether to accept the requested transport.

DELIVERY Service

As is publicly known, the public taxi service is provided for the transport of passengers using our services to reach their destinations safely. However, our drivers and affiliated units are available to provide DELIVERY service, which due to its special characteristics requires particular treatment because:

  • The driver must find a suitable place to park at or near the residence or establishment.
  • Exit the vehicle and approach to pick up the product(s) to transport.
  • Take the necessary security measures for each package, envelope or various items/products to transport.
  • Drive at a very moderate speed so as not to affect or damage what is being transported (cakes, food, beverages, flowers, etc.).
  • Upon arriving at the delivery address, find a suitable place to park, leaving the vehicle.
  • Approach to find the person to whom the product(s) is/are addressed, often in multi-story buildings.
  • Hand-deliver to the customer what was requested or sent.

Products travel in an enclosed, clean vehicle and in the hands of a professional driver, ensuring products arrive in good condition.

In some cases when there is no place to park on the street (which often happens in the city center due to traffic), parking fees must be paid, which will increase the driver's costs while avoiding problems such as illegal-parking fines. This is undoubtedly a Differentiated Service, a Special Service that Taxi Sonrisas is privileged to provide to the customer's satisfaction.

For all of the above, the following must be taken into account: This service has an additional charge of TWO SOLES (S/ 2.00) in addition to the taxi transport service itself, according to the current fare published in the affiliated driver's app and in the Business System.

The driver has a regulated waiting time of up to 6 minutes upon arrival at the point where the delivery service begins. After this time, each additional minute of waiting will have an additional cost of S/ 0.35 per minute.

Likewise, upon arriving at the delivery destination point, the affiliated driver has a maximum waiting time of 5 minutes. After this time, each additional minute of waiting will have an additional cost of S/ 0.35 per minute.

In case the driver, upon arriving at the delivery destination, does not find the person who must receive the delivery, the driver is entitled to wait up to a maximum of 15 minutes from arrival. Of these 15 minutes, 5 are part of the regulated waiting time, but beyond that they count as additional waiting minutes.

Upon completion of this time, the driver may leave the location without any liability to themselves or to Taxi Sonrisas. The driver will immediately go to the company that requested the service to make the corresponding return, and the driver will charge for both the outbound and return service plus waiting minutes.

If the company or person who requested the delivery service requires the driver to return to the same point of origin after completing the task (to return a delivery slip, change, etc.), this service must also be paid for at the current rate.

It is strictly prohibited to request delivery service outside of a real, identifiable physical address, whether a business or residence. This means delivery cannot be requested by a person from a vehicle, motorcycle or as a pedestrian.

If delivery is requested through the Business System or Mobile App, the "REFERENCE" field should contain relevant details that help the driver have detailed and correct information to complete the task.

It is very important to consider product packaging or characteristics for a smooth transfer without incidents. You should also allow the driver to take some security and precautionary measures when packages are closed and travel without a printed delivery slip.

The transport of "non-common goods" that exceed trunk capacity and/or weigh more than 12 kilos and/or take excessive volume — adding modifications to how the driver uses the vehicle (reclining seats, driver responsibility over merchandise, asking the driver to carry packages, using the taxi as cargo transport) — will not be considered delivery service. In such cases, the fare must be coordinated with the driver, who is not obligated to transport the goods and may leave the location without any liability to themselves or to TAXI SONRISAS.

For companies using the Taxi Sonrisas Business System, real-time GPS tracking is available for the unit while heading to the establishment and while delivering the product(s).

*Items such as televisions, sealed packages or boxes, car batteries, as well as items or products of large volume, are not included in this concept. Also not included: supermarket bags, baby strollers, wheelchairs, minor household items that fit in the trunk.

Pet Transport

Regarding this point, we reiterate that taxi service in general is approved and designed for PASSENGER transport. For this reason and out of consideration for passenger users who may suffer from pet odors (which in many cases could cause allergies), pet transport is at the driver's discretion to accept. If transport is possible, the pet must travel in its "CARRIER" to protect the vehicle's cabin and minimize potential odor, hair shedding, etc. Likewise, you should consult with the driver beforehand to agree on the fare, as this is a special service.

Waiting Time

Taxi Sonrisas shall consider the waiting times of our taxi service from when the unit arrives at the service's point of origin. In case the driver must wait for the passenger, once arrived at the point of origin, the driver may wait without surcharge for up to 6 minutes maximum. Beyond that time the driver is authorized to charge S/ 0.35 per minute of waiting, and this waiting time will be included in the final service price.

Hourly Service

  • Hourly service within Metropolitan Trujillo is S/ 32.00 — (If hiring more than 1 hour, S/ 27.00 per hour will be charged).
  • 1-hour service in districts around Metropolitan Trujillo is S/ 37.00. If hiring more than 1 hour, S/ 32.00 per hour will be charged (La Esperanza, El Porvenir, Florencia de Mora).
  • 1-hour service in districts further from Metropolitan Trujillo (Huanchaco, Moche, Campiña de Moche, Villa Marina, Airport, Laredo, Salaverry, Alto Salaverry, Alto Trujillo, El Milagro, Kumamoto, Los Sauces de Barraza and Palmeras de Santa Rosa) is S/ 45.00. If hiring 2 or more hours, the price will be S/ 40.00 per hour.
  • In case of a mixed service (partly within Metropolitan Trujillo, partly outside), the prevailing hourly price is the higher one.
  • The first hour of service is considered complete; subsequent time is in 30-minute increments.
  • Airport service has a special price not included in the hourly services.
  • For routes not in the price list, please ask for a quote.
  • There is a 50% surcharge on national-holiday weekends, Christmas and New Year.
  • Daytime and nighttime rates apply as listed in the current fare schedule.
  • The cost of all services provided by TAXI SONRISAS detailed in these Terms and Conditions will increase by 30% over the listed prices when the customer or user requests a PREMIUM-category unit.

Fare Increase for Year-End Holidays

A 50% fare increase will apply during the Christmas and New Year holidays.

  • Christmas: From December 24 at 3:00 p.m. to December 26 at 5:00 a.m.
  • New Year: From December 31 at 3:00 p.m. to January 2 at 5:00 a.m.

We ask you to take note and plan your activities considering this increase. Thank you for your commitment to providing quality service on these key dates.

Temporary Fare Adjustment Due to Traffic and Maintenance Works in the City

Starting December 20, 2024, temporary fare adjustments apply due to increased traffic and maintenance works in the city.

  • Scheduled services requested (non-Business) to operations at our dispatch 044-233000 are disabled from 12/15/2024 to 12/31/2024 due to high service demand.

Sanitary Protocol for Passenger Users

A safe trip respecting the Sanitary Protocol requires participation from both driver and passenger:

  • You are boarding a Taxi Sonrisas unit that has been fully disinfected and is operating under the established Sanitary Protocol.
  • It is very important that you cooperate with the driver regarding any instructions they may give.
  • If you are traveling in this unit it is because you are wearing a mask; otherwise you would not have been able to board.
  • You must keep the mask on throughout the trip and under all circumstances.
  • If you cough or sneeze you must do so with the mask on and additionally cover with your forearm or a disposable tissue.
  • You must never remove the mask to cough or sneeze on the vehicle's window.
  • Per the Sanitary Protocol, ventilation should be natural — i.e., with side windows open.
  • It is necessary that you also carry medicinal alcohol for personal use; we recommend you bring it in a small sprayer.
  • You can verify on the vehicle's visuals that this unit accepts electronic payment methods and ask the driver.
  • Payments can be made via VISA POS or via BCP's YAPE.
  • If you pay in cash, please be patient as the driver will disinfect the money you hand them and the corresponding change.
  • Upon completing the service, if conditions allow at the place of arrival, please wait for the driver to open the door — only if possible.

Terms and Conditions for the use of the Taxi Sonrisas App

1. Purpose

These General Conditions of Use regulate the use of the TAXI SONRISAS and/or TS CONDUCTOR application (hereinafter, the "Application") and the website www.taxisonrisas.com.pe (hereinafter, the "Website"), either under its current name or any other denomination it may have in the future, of Taxi Sonrisas Premium S.A.C., with RUC N° 20482360492 and fiscal address at Calle Los Rubíes 457, district of Trujillo, province of Trujillo and department of La Libertad, and email address informe@taxisonrisas.com.pe (hereinafter "Taxi Sonrisas"). The Application is directed exclusively at users residing in the province of Trujillo - Peru. Users residing or domiciled elsewhere who decide to access and/or use this Application do so at their own responsibility and risk and must ensure that such access and/or use complies with applicable local legislation. By accessing and using this Application and Website, you ("User") acknowledge that you have read and accepted these General Conditions of Use and agree to comply with all their terms and conditions. Likewise, the User acknowledges and accepts that access to and use of this Application and/or Website will be subject to the General Conditions of Use in force at the time of access. Taxi Sonrisas reserves the right to modify these General Conditions of Use at any time, as well as any other applicable general or particular conditions. Taxi Sonrisas also reserves the right to suspend, interrupt or cease operating the Application and/or Website at any time.

2. Contents

Through the Application, Taxi Sonrisas provides the User with a vehicle-with-driver reservation service (hereinafter, the "Service"). The Application and/or Website provides the User with access to various contents, information and data provided by Taxi Sonrisas in relation to the Service (hereinafter, the "Contents"). Taxi Sonrisas reserves the right to modify the presentation, configuration and location of the Application and/or Website at any time, as well as the corresponding access and use conditions. Taxi Sonrisas does not guarantee that the Contents provided through the Application and/or Website will always be correct, complete or up to date.

3. Access and Use

Access to the Application is limited to persons aged 14 and over. Notwithstanding the above, access to certain content and/or participation in Taxi Sonrisas promotions may be limited to persons of legal age or emancipated minors, as indicated in each case. In general, the User may access the Application and/or Website freely and free of charge. The User acknowledges and accepts that access to and use of the Application and/or Website takes place freely and consciously, under their sole responsibility. Taxi Sonrisas will in no case be responsible for the use that the User and/or third parties may make of the Application and/or Website, nor for damages that may result from it.

The User agrees to make appropriate and lawful use of the Application and/or Website in accordance with applicable law, these General Conditions of Use, morals, generally accepted good customs and public order. The User must refrain from (i) making unauthorized or fraudulent use of the Application and/or Website; (ii) accessing or attempting to access restricted resources of the Application and/or Website; (iii) using the Application and/or Website for unlawful, illegal purposes contrary to these General Conditions of Use, to good faith and public order, harmful to the rights and interests of third parties, or that may damage, disable, overload or impede normal use or enjoyment of the Application and/or Website; (iv) causing damage to the Application and/or Website or to the systems of its suppliers or third parties; (v) introducing or spreading computer viruses or any other physical or logical systems that may cause damage to the systems of Taxi Sonrisas, its suppliers or third parties; (vi) attempting to access, use and/or manipulate the data of Taxi Sonrisas, third-party suppliers and other users; (vii) reproducing or copying, distributing, allowing public access through any form of public communication, transforming or modifying the Contents, unless authorized by the rights holder or legally permitted; (viii) obtaining or attempting to obtain content using means or procedures other than those that, where applicable, have been made available to the User for this purpose.

The User may only access the Application through authorized means. It is the User's responsibility to ensure that they have downloaded the correct Application on their device. Taxi Sonrisas will not be responsible if the User does not have a compatible device or has downloaded a version of the Application incompatible with their device.

4. Additional Conditions for Access and Use

Access to the Application is subject in any case to prior registration by the User by completing the corresponding form ("Registration Form"), which will be provided to the User in advance. Taxi Sonrisas reserves the right to freely accept or reject the User's registration request. The data entered by the User in the Registration Form must be accurate, current and truthful at all times.

Access to and use of the Application or the specific area of the Website will be subject to a password assigned to the User by Taxi Sonrisas upon completing the Registration Form, and access will be deemed made by said User, who will in any case be responsible for such access and use. The User will be responsible at all times for keeping the password safe, accepting any damages that may arise from its misuse, as well as from its assignment, disclosure or loss. In case of forgotten password or any other circumstance that involves a risk of access and/or use by unauthorized third parties, the User will communicate it immediately to Taxi Sonrisas so that the password is immediately blocked and replaced. In any case, any operations carried out before such communication will be deemed made by the User, who will be responsible for and pay the expenses and/or damages arising from any unauthorized access and/or use made prior to such communication.

5. Data Protection

The personal data that the user provides through the Registration Form will be integrated into a personal data file managed by Taxi Sonrisas, maintaining its confidentiality. Unless indicated otherwise, without prejudice to the fact that providing Personal Data to Taxi Sonrisas is voluntary, failure to provide such Personal Data may affect the quality of the services provided by Taxi Sonrisas.

Users' Personal Data is included in an automated file by Taxi Sonrisas to, among others, maintain an adequate relationship with the User; facilitate access to the service provided by Taxi Sonrisas; provide, manage, administer, expand and improve the services and/or contents offered in the Application; as well as to adequately address any query or request for information raised by Users and, where appropriate, to send information about services or activities of Taxi Sonrisas that may be of interest to Users.

In any case, and in compliance with the provisions of e-commerce legislation, at the time of data collection, Users will be asked for their express consent so that Taxi Sonrisas may use their data to send them information and advertising via email or equivalent means, such as SMS to mobile phones.

If the User later wishes to revoke their consent to receive commercial information via email or any other similar or equivalent means, they may do so by sending an email to informes@taxisonrisas.com.pe, without prejudice to the rights of access, rectification, cancellation and opposition that assist them and that they may exercise in accordance with section 6 of our terms and conditions of use.

6. User Rights

The User may exercise at any time their rights of access, rectification, cancellation and opposition to the processing of their Personal Data, by request to the following email address: informes@taxisonrisas.com.pe.

7. Security

Taxi Sonrisas declares and guarantees that it will at all times make its best efforts to maintain the security and confidentiality of Personal Data and that it will continue to improve the security measures adopted in line with any legal and technological developments.

8. Exclusion of Warranties and Liability

Taxi Sonrisas does not guarantee the availability and continuity of operation of the Application and/or Website. Consequently, Taxi Sonrisas will in no case be liable for any damages that may arise from (i) the lack of availability or accessibility to the Application and/or Website; (ii) the interruption in the operation of the Application and/or Website or computer failures, telephone breakdowns, disconnections, delays or blockages caused by deficiencies or overloads in telephone lines, data centers, the Internet system or other electronic systems produced during its operation; and (iii) other damages that may be caused by third parties through unauthorized intrusions outside the control of Taxi Sonrisas.

Taxi Sonrisas does not guarantee the absence of viruses or other elements in the Application and/or Website introduced by third parties outside Taxi Sonrisas that may cause alterations in the User's physical or logical systems or in electronic documents and files stored in their systems. Consequently, Taxi Sonrisas will in no case be liable for any damages of any kind that may arise from the presence of viruses or other elements that may cause alterations in physical or logical systems, electronic documents or files of the User.

Taxi Sonrisas adopts various protection measures to protect the Application and/or Website and its contents against computer attacks from third parties. However, Taxi Sonrisas does not guarantee that unauthorized third parties cannot know the conditions, characteristics and circumstances under which the User accesses the Application and/or Website. Consequently, Taxi Sonrisas will in no case be liable for damages that may arise from such unauthorized access.

The final provision of the transport service shall be at the discretion of the third-party carrier. If, once the User's request has been processed, the third-party carrier refuses to carry out the trip due to the destination or any other cause, the User may contact Taxi Sonrisas so that, to the extent possible, Taxi Sonrisas provides the User with a replacement vehicle.

9. Notifications

Taxi Sonrisas may make notifications through a general notification in the Application, through the email address provided by the User in the Registration Form, or by regular mail to the address provided by the User in the Registration Form. The User may notify Taxi Sonrisas by sending an email to informes@taxisonrisas.com.pe.

10. Assignment

The User may not assign their rights and obligations under these General Conditions of Use without Taxi Sonrisas' prior written consent. Taxi Sonrisas may assign, without the need to obtain prior consent from the User, these General Conditions of Use to any entity within its business group, worldwide, as well as to any person or entity that succeeds it in the exercise of its business by any means.

11. Applicable Law and Jurisdiction

These General Conditions of Use, as well as the relationship between Taxi Sonrisas and the User, shall be governed and interpreted in accordance with Peruvian law. The parties agree to submit to the exclusive jurisdiction of the courts and tribunals of the User's place of residence for the resolution of any dispute regarding these General Conditions of Use or the relationship between them.

12. Complaints Book

In accordance with current Peruvian legislation, Law N° 29571 and Supreme Decree N° 011-2011-PCM, all commercial establishments open to the public must have a Complaints Book, either physical or virtual. You can find the Taxi Sonrisas Premium Complaints Book at the Trujillo office: Calle Los Rubíes 457, Trujillo, Peru.

13. Conditions of Use of the Transport Service

Any damage that a user causes to vehicles and/or drivers will be assumed by the user themselves, including the hours during which the vehicle has been out of service due to said damage. In this case, Taxi Sonrisas Premium S.A.C. will charge the user the corresponding amount via the payment method usually used by the user for the service, sending the corresponding payment receipt for the repair — including but not limited to breakages, stains, scratches, burns and any other similar damage to the interior or exterior of the vehicle, as well as the driver's physical integrity, and also for the hours the affected vehicle has been out of service due to said damage caused by the user or invited passengers. Likewise, we ask users to take care of, review and collect their belongings at the end of the trip to avoid losses, for which we cannot be held responsible once the trip is over.

Privacy Policies

This Privacy Policy establishes the terms under which Taxi Sonrisas Premium S.A.C. uses and protects the information provided by its users when using the mobile application. This company is committed to the security of users' data. When we ask you to fill in personal information fields by which you may be identified, we do so ensuring that it is only used in accordance with the terms of this document. However, this Privacy Policy may change over time or be updated, so we recommend and emphasize that you regularly review this page to ensure you agree with such changes.

Use of collected information

Our Application uses the information to provide the best possible service, particularly to maintain a record of users and services rendered. Emails may be sent periodically through our site with special offers, new products and other promotional information that we consider relevant to you or that may provide some benefit. These emails will be sent to the address you provide and may be cancelled at any time through a request via the same channel.

Taxi Sonrisas Premium S.A.C. is highly committed to keeping your information secure. We use the most advanced systems and update them constantly to ensure there is no unauthorized access.

What information we collect

1. Information provided by users. Upon registering a user account, the following are collected: first and last names, phone number, email address.

2. Information collected automatically. Upon requesting a service, the GPS location provided by the user, address and address reference are saved, as well as addresses that users save.

How we use your information

The data is used to provide users with the transportation services they request, and likewise to indicate to the driver the address and name of the user being picked up.

The addresses that the user requests to save are used to show them to the user so they can use them when requesting service to those addresses.

Personal Data Controller

The responsible party and recipient for processing the Personal Data is Taxi Sonrisas Premium S.A.C.

  • Taxi Sonrisas Premium S.A.C., a Peruvian company that operates the Transport Service in Peru. Postal Address: Los Rubíes 457 Urb. Santa Inés, Trujillo, La Libertad, Peru.

Collected personal data is stored in a virtual Database, hosted on a Server of the company NISIRA SYSTEM S.A.C.

The physical location of the data center is:

  • Calle South Ellis, Phoenix, Arizona - USA
  • E. Collins Blvd, Richardson, Texas - USA

These maintain adequate protection levels to ensure the confidentiality and security of said data and cross-border flow. To this effect, the user consents to such data transfer under the terms and conditions indicated.

How we share your information

The information provided by the user is shared as follows:

  • With drivers: the user's name, point of origin address and GPS location of the point of origin are provided. This way, drivers can locate the customer to provide the taxi service.
  • With businesses affiliated with our Sonrisas Wallet, the name and phone number are shared through our business platform, only at the moment the user redeems/sends their Sonrisas points, in order to communicate with the user in case of any issue with the benefit/promotion transaction.

How we protect your information

We adopt reasonable and appropriate technical, administrative and physical security measures suited to the nature of the personal information in question, designed to protect your personal information against loss, theft, misuse and unauthorized access, disclosure, alteration and destruction.

We periodically review our security measures to take account of new available technologies and methods. But guaranteed security does not exist inside or outside the Internet. We cannot guarantee the security of your information, even against intrusions or unauthorized actions by third parties. However, we make commercially reasonable efforts so that the collection and security of such information is consistent with this policy and with all applicable laws and regulations.
